of Sale
Payment
A deposit of
50% with each order is required and the balance payment one week
prior to delivery, or in cleared funds on delivery, subject to status.
Any late payment, or problems with payment, J S Classics Ltd reserves
the right to reclaim any costs involved in collection, or administering
any outstanding payments. The person who places the order for a
machine, is deemed to have taken personal responsibility for the
payment for that machine.
Ownership and
Title
Title shall
not pass to the customer, until payments has been received in full,
in cleared funds.
Cancellation
When a customer
orders a machine ether verbally, in writing, or by making a payment,
they agree to be bound by that order and cancellation of that order
will only be allowed at the discretion of J S Classics Ltd. Should
a customer wish to cancel an order a cancellation fee may apply.
Collection or
Delivery
Customers who
are collecting their machines, must do so within 10 days of notification
that the machines are ready. After this time J S Classics Ltd shall
be entitled to charge storage fees. All our machines are tested
prior to delivery, if a customer arranges for their own delivery,
J S Classics Ltd will not be held responsible for the machine arriving
at the customers in working condition. Promises of delivery dates
are made in good faith and are adhered to as closely as possible,
but may need to be varied from time to time, due to unforeseen circumstances
arising. J S Classics Ltd accepts no responsibility for any losses,
costs, or expenses incurred by the customer, in the event of a delayed
completion, for whatever reason.
Warranties
All machines
purchased from J S Classics Ltd will be covered by the following
warranty :
Machines purchased
for domestic use – 12 months back to base parts and labour.
Machines purchased for commercial use – 6 months back to base
parts and labour.
Upgrades - Warranty
and Onsite Service upgrades are available - prices vary per machine,
please ask for details.
Any repair,
service, or modification carried out on any machine by the customer,
or any unauthorised third party during the warranty period, may
invalidate the warranty.
General
If any part
of these Terms & Conditions, are found to be invalid by any
competent authority, then this shall not affect the rest of the
Terms & Conditions, which shall stay in force.
The customer shall exercise due diligence in protecting the copyrights
in the goods, so far as it lies in its power.
J S Classics Ltd does not accept any liability for damage to the
machine as a result of misuse.
Any complaints about machines, should be made in writing to J S
Classics Ltd, within 7 days of delivery.
Definitions
Back to base
– Customer is responsible for the cost and organisation of
the safe return and collection of the machine.
On site – Engineer will visit the machine on site at the earliest
available date. Should the machine not be able to be repaired on
site, the engineer will take the machine back to the workshop, affect
the repair and return it to the customer at the earliest available
date. On site engineer visits are chargeable unless covered by a
warranty upgrade. All engineer visits will be by appointment, if
the engineer cannot gain access at the agreed time, then a call
out fee may be charged.
Act of God
J S Classics
Ltd shall not be held liable if it shall be unable to carry out
any provision of the contract for any reason due to reasons beyond
their control.
Law
These terms
& conditions shall be governed by English Law and both parties
agree to submit to the jurisdiction of the English courts.
